Last week almost 85% of Toll Dnata staff across the country voted to
accept the EBA negotiated by your TWU and rank and file delegates. This
is a great victory for members across Toll Dnata and is the first
national union agreement in almost 10 years at these workplaces -
delivering all the key provisions outlined below.
This is a big step forward for members at Toll Dnata and means that TWU members are covered by an agreement that delivers for them and their families.
Changes under the new agreement include:
• a new maximum average 40 hour week for full time staff with all hours over 40 hour per week paid at the rolled in rate as overtime
• a new CPI safety net to make sure that wage increases keep up with the cost of living (clause 17.3)
• a commitment to convert casual and contract staff to Toll Dnata full time or part-time staff once the agreement is approved (clause 15.11)
• 8 weeks annual leave entitlements per year, pro-rata for part-timers (clause 20)
• access to annual leave in less than one week blocks, ie single days where agreed (clause 20)
• new rules requiring 7 days notice of roster changes for all employees
• new overtime penalties payable when less than 7 days notice for roster changes are given (clause 16.4)
• a new consultative committee clause making sure TWU delegates and representatives will continue to have a say protecting your future at work (clause 36)
• a new OH&S committee clause to ensure your workplace safety (clause 36)
• rights for all staff to vote on the agreement
• new higher duties provisions to make sure employees are paid for all work done at a higher rate (clause 17.17)
• new provisions to make sure employees acting up in higher roles for extended periods have a right to the higher job (clause 17.18)
Other provisions of the agreement include:
• a 3% pay increase each year of the agreement (or CPI, whichever is the greater) that means wages are protected for increases in the cost of living
• a three year agreement from 1st of May 2010 to 1 May 2013
• a commitment to renegotiate a new agreement 6 months prior to the expiration of this new agreement
• rights for casuals working over 12 months to a full time or part-time job
• rights for part-time employees working full time hours to a full time job
• a commitment to pay all employees on site the same rates of pay
• induction and training rights for TWU delegates and all new employees
• access to an independent umpire to settle any disputes between employees and Toll Dnata
